1. Acceptance of Terms
By accessing or using CrewPathPro.com, a software platform owned and operated by MV Code Foundry LLC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use the platform.
2. Platform Overview
CrewPathPro.com provides cloud-based operations software for service-based businesses, including tools for:
- Job estimates and phased invoices
- Basic and recurring invoicing
- Job tracking, scheduling, and team management
- Customer relationship and service data management
- Secure merchant payment processing (PCI-compliant)
We reserve the right to add, modify, or remove features at any time.
3. Subscription Terms & Billing
3.1 Monthly Access
CrewPathPro.com is a subscription service. You agree to pay the applicable subscription fees based on your selected plan. Until our recurring billing integration is live, payments must be made manually via:
- Zelle to Payments@CrewPathPro.com
3.2 Future Auto-Pay Setup
Once automated billing is available, your payment method on file will be charged automatically. You will receive notice before the first auto-renewal.
3.3 Declined Transactions & NSF Fees
If a check is returned due to non-sufficient funds, a $34.00 fee will be charged. The outstanding amount and NSF fee must be paid via certified funds to maintain software access.
4. Estimates, Invoices & User Responsibility
CrewPathPro.com provides tools for estimates, invoicing, and customer billing. Users are responsible for:
- Ensuring legal and tax compliance of all generated documents
- Reviewing invoices for accuracy
- Collecting payment from customers according to applicable laws
CrewPathPro.com is not liable for errors, omissions, or disputes related to tax rates, legal notices, or estimate acceptance.
4.1 Financial Accuracy Disclaimer
CrewPathPro.com does not provide financial, tax, legal, or accounting advice. Users are responsible for validating all financial records generated via the platform. The platform is not a substitute for professional accounting systems or compliance audits.
5. Merchant Processing & PCI Compliance
5.1 Secure Processing
All payment processing through CrewPathPro.com is managed via a PCI-DSS Level 1–compliant payment partner. Payment data is encrypted, tokenized, and never stored directly by CrewPathPro.com.
5.2 User Obligations
You agree to:
- Only submit authorized transactions
- Protect account login credentials
- Not misuse or store cardholder data
- Cooperate in chargeback or fraud investigations
5.3 Chargebacks & Holds
Transactions may be reversed due to fraud, disputes, or authorization failure. Funds may be held or reserves established to mitigate risk. You agree to timely reimburse any such funds owed.
5.4 No Disclosure of Processor
For branding continuity and user experience, CrewPathPro.com does not publicly disclose the name of its backend processor. However, all merchant services adhere to industry, legal, and PCI DSS standards.
5.5 Data Security & Breach Notification
Users must notify CrewPathPro.com within 24 hours of any suspected or confirmed data breach involving cardholder data or account credentials. CrewPathPro.com reserves the right to suspend access, investigate breaches, and report findings to processors, banks, and regulators.
5.6 PCI User Responsibility
Users acknowledge responsibility for maintaining PCI-compliant practices within their business operations and systems. CrewPathPro.com is not liable for breaches or non-compliance caused by user-side environments.
6. Platform Access & Account Suspension
Access may be suspended for:
- Non-payment
- Misuse of the platform
- Violation of these Terms
You have 15 days after cancellation or termination to export your data. After this period, your data may be deleted without notice.
7. Intellectual Property
CrewPathPro.com and all related software, designs, workflows, and IP are the sole property of MV Code Foundry LLC. You may not copy, replicate, reverse-engineer, or reuse any platform components.
8. Limitation of Liability
CrewPathPro.com is provided "as-is" and "as-available." We do not guarantee uptime or uninterrupted access. Our liability is limited to the amount paid in the 30 days prior to any issue. We are not liable for indirect or consequential damages.
8.1 Forward-Looking Statements
Certain statements, projections, or feature plans made through the platform or affiliated materials may be forward-looking in nature. These are not guarantees of future performance and are subject to change.
8.2 Securities Disclaimer
Nothing in this agreement or the use of CrewPathPro.com constitutes an offer to sell or a solicitation of an offer to buy securities. Any investment-related materials are governed by separate legal agreements and are not part of this Terms of Service.
9. Termination
Either party may terminate these Terms at any time. You are responsible for all charges incurred prior to termination. No refunds will be provided for partial months.
10. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Colorado. Disputes shall be resolved via binding arbitration in Denver County, Colorado.
11. Changes to Terms
We may update these Terms at any time. Continued use of the platform after such updates constitutes your agreement to the revised terms.
11.1 Compliance with Law
Users agree to comply with all applicable laws and regulations, including those enforced by the FTC, SEC, IRS, card networks, and state consumer protection authorities.
